The Court of Appeal


The Court of Appeal last week dismissed contractor Mowlem's appeal against an injunction granted to Bath and North East Somerset Council, which allowed other contractors to carry out work at the troubled Bath Spa site (NCE 5 February). Mowlem was also ordered to pay the council's costs of £22,500.

Mowlem has this week been asked to remove all of the defective paint from the site. A spokesman for Mowlem said it was the refusal of the council to issue such an instruction in August 2003 that led to court proceedings in the first place.
