A draft order to pass responsibility of Crossrail from the Department for Transport to Transport for London (TfL) has been published, to complete in November.
Once complete, then TfL will assume complete control and responsibility for Crossrail.
A date for the handover has not been agreed, but would be expected to happen shortly after the end of the consultation period.
Once the order is passed, Crossrail Limited will no longer need to petition the DfT to acquire land for the construction of Crossrail.
Under the current regime, Crossrail petitions the department to acquire land, and this land is then transferred to TfL. This power would now be devoluted directly to TfL.
According to the supporting literature from the DfT, this would: “Be desirable for two reasons. Firstly, it will streamline the acquisition process, reducing the need for multiple approvals from different organisations and removing the step of transferring land ownership from the Secretary of State to Transport for London. This will significantly reduce the administrative burden on all organisations involved.
“Secondly, it will remove the need for the Department for Transport’s procurement of independent advice, meaning a considerable saving on the Department’s consultancy spend.
“Acquisitions begun by the Secretary of State prior to devolution of powers can be continued by Transport for London as if Transport for London had begun the acquisition. There may also be some exceptional cases where the Secretary of State has retained ownership of land acquired before devolution. In these circumstances the Secretary of State will need to retain several powers over the land”.
