I am not a lawyer and not able to comment on Michael Woods' belief that there is a conflict between the use of 'Telecare' and the Human Rights Act (NCE last week), but it is not the case that all privately run care homes are unable to stay open on the fees paid by local authorities.

In Milton Keynes we have recently negotiated a contract with Excelcare which will provide 270 beds in new state of the art care homes, which will exceed the national minimum standards. These will be provided within our standard price bands.
