Dispute resolution

Courses and training

Resolution of disputes remains an important issue for construction firms and training is available to make the process less arduous.

Kingston University is accepting the third annual intake of students to its MA/Diploma in Arbitration & Disputes Resolution in September 2001.

'Dispute resolution is still important despite the best efforts of many in the industry to work in a more co-operative fashion, ' says Kingston's course director Eddie Ryan.

'The course attempts to give our students the ability to resolve disputes more effectively should they arise. We look at all forms of dispute resolution including arbitration, statutory forms of adjudication and the benefits of mediation, ' says Ryan.

Kingston's MA/Diploma, which received official approval from the Chartered Institute of Arbitrators earlier this year, consists of eight taught modules including legal obligations and dispute management. Students also get involved in mock adjudications, mediations and written arbitration sessions. The course is also designed to be flexible with students able to study over a two or three year period.

Senior consultant Melvin Earley of US cost management specialist Faithful & Gould, part of the WS Atkins group of companies, has completed the diploma section of the course and is hoping to attain the Masters degree by finishing his dissertation in October.

Earley, who relocated to Faithful & Gould's New Jersey office from London in October 2000, says: 'The overall philosophy of avoiding disputes in the first place is a good one, but ultimately disputes will occur. It is in the disputant's best interest to be in a position to take informed decisions on the most appropriate course of action to take, and the alternative dispute resolution strategies available.'
